If you or a loved one were injured due to a defective medical device, the first thing you must do is preserve the device in question. Often times a device is identified as malfunctioning for some reason, and surgery is immediately scheduled to either rectify the issue or to replace the faulty device. When that happens, medical providers will observe the device, make a note in the surgical report, and then discard the device. When that happens, it can be fatally detrimental to your potential claim against the manufacturer of the device for having a defective device. As such, it is crucial to determine where the device in question is located and to preserve it at all costs.
